Terms and conditions

This is an operational MVP template, not a substitute for legal advice. Review it for the final business identity, pricing, charity arrangement, service providers, and Ontario consumer-law obligations before accepting orders.

1. Agreement

These terms govern use of AngelFur, operated by AngelFur. By creating an account, publishing content, submitting a condolence, or placing an order, you agree to these terms and the privacy and refund policies.

2. Eligibility and accounts

You must have reached the age of majority where you live and provide accurate account information. You are responsible for protecting your password and for activity performed through your account. Email verification is required before creating a memorial or placing a song order.

3. Free memorial service

The MVP allows a verified account holder to publish a public pet memorial containing one photograph and a plain-text tribute of no more than 2,000 words. The owner can edit, unpublish, and control condolence submissions. The configured number of free memorials per account may be limited to manage abuse and capacity.

4. Public content and permissions

You keep ownership of content you submit. You grant the service a non-exclusive, worldwide, royalty-free licence to host, resize, reproduce, display, back up, and distribute that content only as needed to operate and promote the memorial service. You confirm that you own the content or have permission to use it and that publication does not violate privacy, copyright, publicity, confidentiality, or other rights.

5. Prohibited content

Do not submit illegal, threatening, hateful, sexually explicit, fraudulent, defamatory, invasive, malicious, copyrighted-without-permission, or technically harmful material. Do not impersonate another person, publish confidential records, upload malware, or use the service to harass someone. We may remove content, disable access, or preserve records when reasonably necessary for safety, legal compliance, or investigation.

6. Condolences

Condolences may be reviewed by the memorial owner or administrator before publication. Submission does not guarantee publication. We may approve, reject, remove, or disable messages to keep memorials respectful, prevent spam, or respond to complaints.

7. Personalized song service

A song order includes the selected genre, a manually reviewed production process, a private preview, one revision request, and final audio delivery after approval. Production begins only after e-transfer payment is manually confirmed. The service may use commercially licensed generative-music and language tools together with human selection and editing.

8. Song limitations

The customer must provide accurate names, pronunciation, memories, and exclusions. The service does not promise that a generative output will qualify for copyright protection or be exclusive. Requests to imitate a named living artist, copy an existing song, clone a person’s voice without documented authority, or use unlicensed lyrics or recordings may be refused. Customer use remains subject to any applicable rights and provider terms disclosed at the time of delivery.

9. Revisions

One revision request is included. It must identify concrete factual, pronunciation, lyric, mood, or musical changes. A revision is used when the request is submitted. Further versions or substantial changes to the original questionnaire may require a new paid order.

10. Prices and e-transfer

Prices are shown in Canadian dollars unless stated otherwise. The current MVP accepts e-transfer. An order is not considered paid until an administrator confirms receipt. Customers must include the order number in the transfer message. Taxes will be added when legally required and the checkout and confirmation process must be updated accordingly.

11. Delivery

Delivery dates are estimates unless a specific written deadline is accepted. Access to previews and completed audio requires the customer account. Customers should download and back up final files. Public playback on a memorial occurs only when requested by the customer and completed by the administrator.

12. Donations and charity references

No charity logo, endorsement, tax-receipt promise, or donation representation should be displayed until the business has documented the amount or formula, payment schedule, eligible charity, authorization, accounting treatment, and public wording. When enabled, the website will state the exact donation commitment rather than using vague “portion of proceeds” language.

13. Availability

The service may change, suspend, or discontinue features. “Lifetime” or “forever” availability is not promised. We will make reasonable efforts to maintain the service and provide practical export or download options, but outages, provider changes, security events, and business closure remain possible.

14. Disclaimers and liability

The service is provided on an “as available” basis. To the maximum extent permitted by law, the business is not responsible for indirect, incidental, special, or consequential losses, third-party copying of public content, search-engine caches, provider outages, or emotional expectations that cannot be objectively guaranteed. Nothing in these terms excludes rights or remedies that cannot legally be excluded.

15. Termination and governing law

We may suspend accounts or remove content for material breaches, fraud, abuse, security risk, or legal requirements. These terms are governed by the laws applicable in Ontario and Canada, without limiting mandatory consumer rights in another jurisdiction.
